1. Acceptance of Terms

By accessing or using the TafSocial website, platform, and services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Services. These Terms govern your use of the Services provided by TafSocial.

2. Description of Service

TafSocial is an AI-powered social media content generation and management platform. We provide tools to help brands generate text, images, and marketing content using advanced artificial intelligence APIs based on user inputs, brand assets, and web scraping.

The Services are subject to change, modification, or termination at our discretion.

3. Account Registration & Security

You must register for an account to use most features of our Services. You are responsible for safeguarding your password and any other credentials used to access your account. You agree to take full responsibility for any activity or actions under your account, whether you have authorized such activities or not.

You must provide accurate and complete information upon registration and keep it up to date. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. Credits, Payments, and Billing

TafSocial operates on a pay-as-you-go credit system. By purchasing credits, you agree to the following terms:

• Pricing: Credits are purchased at the prevailing rate specified on our billing page, currently optimized to provide accessible pricing for generations and scraping.
• Payment: All payments are processed securely via our third-party payment processor, Stripe. We do not store your credit card details.
• Refunds: Payments for credits are non-refundable unless required by law. Unused credits do not expire as long as your account remains active.
• Consumption: Credits are deducted from your balance immediately upon the initiation of a generation or scraping task, regardless of the final outcome. In the event of a system failure on our end, credits may be refunded to your balance at our sole discretion.

5. User Conduct and Content

You retain all rights to the brand assets, text, and data you upload to the platform ("User Content"). You grant TafSocial a license to use, store, and process this User Content solely for the purpose of providing the Services to you.

You agree not to use the Services to:

• Generate content that is illegal, defamatory, hateful, discriminatory, or infringes on the intellectual property rights of others.
• Scrape or extract data from websites where you lack explicit authorization or where such action violates the target site's Terms of Service.
• Attempt to reverse engineer, decompile, or otherwise compromise the security or integrity of the TafSocial platform or underlying AI models.

6. Intellectual Property

The Services and their original content (excluding User Content and AI-generated outputs provided to you), features, and functionality are and will remain the exclusive property of TafSocial and its licensors.

AI-Generated Content: Subject to your compliance with these Terms, you commercial rights to the content generated for you through the platform, subject to the terms and limitations imposed by our underlying AI providers (such as Google and Replicate).

7. Limitation of Liability and Disclaimers

The Services are provided on an "AS IS" and "AS AVAILABLE" basis. TafSocial makes no warranties regarding the reliability, accuracy, or availability of the Services or the generated AI content.

In no event shall TafSocial, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Services. Our total liability shall not exceed the amount you paid to us for the specific services in the past 12 months.

8. Termination

We may terminate or suspend your account and bar access to the Services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

Upon termination, your right to use the Services will immediately cease. If you wish to terminate your account, you may simply discontinue using the Services or delete your account from the dashboard.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
